1. About Bigmedia24 Dynamics Ltd.

This website and related booking platforms are operated by:

These Terms of Use and Booking Conditions (“Terms”) govern your use of websites, booking portals, white-label solutions and related services operated by Bigmedia24 Dynamics Ltd. (“Bigmedia24”, “we”, “us”, “our”).

By accessing or using any Bigmedia24 website or service, you agree to be bound by these Terms.

2. Scope of These Terms

These Terms apply to:

  1. Travellers / Guests (B2C)
    Individuals who browse our websites, search for travel services or make bookings (for example accommodation, packages, related services) via platforms operated by Bigmedia24 or its white-label partners.

  2. Property Owners & Managers (B2B)
    Professional operators of accommodation, including but not limited to:
    large hotel complexes and resorts, city and business hotels, boutique hotels, serviced apartments, aparthotels, guesthouses, B&Bs, villas, chalets, cabins, holiday homes, privately rented apartments and professionally managed rentals (together “Properties” or “Property Partners”).

  3. OTAs, Travel Brands, Affiliates & Other Partners (B2B)
    Online travel agencies, travel brands, affiliates, publishers and other commercial partners using our white-label solutions, APIs or other platform services (“Partners”).

Additional or more specific terms may apply to certain services (for example affiliate programmes, white-label solutions, API access or specific sales agreements). Where such specific terms are agreed in writing, they take precedence over these general Terms to the extent of any conflict.

3. Role of Bigmedia24

Unless explicitly stated otherwise in a specific product or contract:

  • Bigmedia24 operates technology platforms that connect travellers, Properties and Partners.

  • For most accommodation bookings, Bigmedia24 acts as a platform and/or intermediary, not as the actual provider of accommodation or travel services.

  • The accommodation contract is concluded directly between the traveller and the Property, based on the conditions displayed at the time of booking (including cancellation policies, house rules and price conditions of the Property).

  • Bigmedia24 is not a party to the accommodation contract and is not the organiser of a package holiday within the meaning of applicable package travel legislation, unless this is clearly stated for a specific product.

Bigmedia24 may also provide white-label OTA solutions and technology infrastructure to Partners. In such cases:

  • The Partner may appear as the primary brand towards travellers.

  • Bigmedia24 provides the underlying platform, integrations and operational infrastructure as a B2B service provider to the Partner.

Nothing in these Terms creates an employment, agency, partnership or joint venture relationship between Bigmedia24 and a Property or Partner beyond the explicitly agreed contractual arrangements.

4. Eligibility & Account Registration

To use our services, you must:

  • be at least 18 years old (or the age of legal majority in your country of residence); and

  • have the legal capacity to enter into binding contracts.

When you create an account or register a Property or Partner profile, you must:

  • provide accurate, current and complete information;

  • keep your login credentials confidential; and

  • update your details if they change.

You are responsible for all activities that occur under your account. If you suspect unauthorised use of your account, you must inform us without undue delay via chat or email.

5. Property Registration & Platform Model

5.1 Free Registration

Property owners and managers can register their Properties on Bigmedia24-operated platforms free of charge:

  • no registration fee;

  • no ongoing listing fee solely for being present on the platform.

This applies to all supported accommodation types, including large hotels, resorts, city hotels, boutique hotels, serviced apartments, aparthotels, guesthouses, B&Bs, villas, chalets, cabins, holiday homes and privately rented apartments that are professionally managed.

5.2 Platform Fee per Booking

For bookings generated via Bigmedia24 platforms or integrated white-label environments:

  • Bigmedia24 charges a 10% platform fee on the relevant booking amount (the “Platform Fee”).

  • The remaining 90% of the booking amount is paid out to the Property in real time (as defined below), subject to payment and settlement processes agreed between Bigmedia24 and the Property.

  • The Platform Fee is considered remuneration for the use of the platform, technology, infrastructure, distribution and related services provided by Bigmedia24.

Specific contractual arrangements between Bigmedia24 and a Property may further regulate the technical and financial details of this model. In case of conflict, such specific agreements prevail.

5.3 Real-Time Payout

Real-time payout” means that:

  • once a booking is successfully completed and payment is authorised in line with the agreed payment flows, 90% of the booking amount is released to the Property without Bigmedia24 waiting for the guest’s actual check-in or check-out date; and

  • the timing of the final value date on the Property’s account may still depend on the payment method, banking hours, intermediary financial institutions and technical settlement processes.

Local laws, anti-money-laundering rules, sanctions compliance and payment provider requirements may require additional checks and can influence timing. Where a payout must be delayed or adjusted due to legal or technical constraints, Bigmedia24 will act in good faith and in accordance with legal obligations.

6. Cancellation Policies & Property Conditions

Each Property is responsible for defining its own:

  • cancellation policies (for example flexible, semi-flexible, non-refundable);

  • prepayment and deposit rules;

  • house rules and special conditions (for example age restrictions, pet policies, smoking restrictions);

  • additional fees (for example resort fees, cleaning charges, local taxes, city taxes), where legally permissible.

These conditions are displayed to travellers during the booking process and form part of the contract between the traveller and the Property.

Properties must ensure that:

  • their policies comply with applicable laws (including consumer protection and local regulations);

  • conditions are clearly and transparently communicated;

  • obligations towards travellers arising from such policies are fulfilled.

Bigmedia24 is not responsible for the substance or legality of a Property’s policies; they are set and controlled by the Property.

7. Booking Process for Travellers

When you make a booking via a Bigmedia24-operated platform (including white-label portals):

  1. You select a Property, room or unit type, dates, number of guests and any additional services.

  2. The platform displays the applicable price, taxes/fees (if specified), cancellation policy and other conditions provided by the Property.

  3. You enter the required personal and payment data and confirm the booking.

  4. The booking is transmitted to the Property (or its connected systems, such as a PMS or channel manager).

  5. You receive a booking confirmation (normally by email, and/or via the platform).

By completing a booking, you enter into a legally binding agreement with the Property under the conditions displayed at the time of booking. You are responsible for reviewing those conditions carefully before confirming.

Where applicable, you may have statutory rights (for example cooling-off, cancellation or refund rights) under the consumer laws of your country of residence. Nothing in these Terms is intended to limit any non-waivable rights granted by mandatory law.

8. Prices, Taxes & Payment

  • Prices displayed on our platforms are generally provided by Properties or Partners and may include or exclude taxes and fees, depending on the applicable jurisdiction and configuration.

  • Where sums are displayed as “total” or “tax included”, this is based on information from the Property or Partner.

  • You are responsible for verifying which charges are included in the price and which additional charges (for example local city taxes) may be payable directly at the Property.

Payment flows can vary:

  • In some cases, Bigmedia24 (or an integrated payment provider) may collect payment from the traveller and forward the relevant share to the Property.

  • In other cases, payment is collected directly by the Property according to its policies.

Details are communicated during the booking process.

Currency conversions are provided for convenience only, unless explicitly stated as binding. Your bank or payment provider may apply additional charges or exchange rates.

9. Traveller Responsibilities

As a traveller, you agree to:

  • provide true, complete and accurate information during the booking;

  • inform the Property of any special requirements (for example accessibility, medical needs, late arrival) before arrival;

  • comply with the Property’s house rules and policies;

  • pay all amounts due in connection with your booking, including additional charges or local taxes if applicable.

If you do not show up, cancel late or otherwise breach the agreed conditions, the Property’s cancellation or no-show policy applies.

10. Property & Partner Responsibilities (B2B)

Property owners, managers and Partners using Bigmedia24 services agree to:

  • provide accurate, up-to-date information about their Properties, inventory, prices, policies and availability;

  • ensure that all content (text, images, data) provided to Bigmedia24 does not infringe third-party rights and complies with applicable laws;

  • honour all bookings made via the platform in line with the conditions presented to travellers;

  • handle on-site service, fulfilment, check-in/out and customer care related to the actual stay;

  • comply with applicable legal requirements (including licensing, tax, safety and consumer protection rules) in the jurisdictions where they operate.

Bigmedia24 may suspend or terminate access to the platform for Properties or Partners that:

  • repeatedly provide misleading, incomplete or unlawful information;

  • fail to honour bookings;

  • breach these Terms or specific agreements with Bigmedia24;

  • engage in fraud, abuse or illegal conduct.

Additional or more detailed obligations may be set out in separate partner, affiliate, sales or white-label agreements.

11. Platform Availability & Service Changes

Bigmedia24 aims to operate its platforms with high availability and reasonable performance. However:

  • we do not guarantee uninterrupted or error-free service;

  • maintenance, updates, security measures or technical issues may temporarily affect availability;

  • certain functions may be changed, added or removed over time to improve the platform.

We are not liable for temporary unavailability, interruptions or malfunctions, except to the extent required by mandatory law.

12. Intellectual Property

Unless expressly stated otherwise:

  • all software, platform components, design elements, texts, graphics, logos, trade marks and other content on Bigmedia24 platforms are owned by or licensed to Bigmedia24;

  • you may use our platforms only for their intended purpose (for example searching, booking, managing your Property) and in accordance with these Terms;

  • you may not copy, modify, reverse engineer, resell, deep-link (except where clearly permitted) or otherwise misuse the platform or its content.

Property and Partner content (for example hotel descriptions, images, logos) remains the property of the respective rights holders. By providing such content to Bigmedia24, Properties and Partners grant Bigmedia24 a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt and display such content as necessary for operating the platform and related marketing activities, in accordance with applicable law and any specific contractual agreements.

13. Data Protection & Privacy

Processing of personal data in connection with the use of Bigmedia24 platforms is governed by our Privacy Policy, which forms an integral part of these Terms.

By using our services, you acknowledge that your personal data will be processed in accordance with that Privacy Policy and applicable data protection laws.

14. Cookies & Similar Technologies

Our use of cookies and similar technologies is described in our Cookie Policy.

By using our platforms, you consent to the use of cookies and similar technologies as set out in the Cookie Policy, unless you disable them via your browser or consent tools where available.

15. Prohibited Uses

You may not use our platforms for any unlawful or abusive purpose, including but not limited to:

  • attempting to gain unauthorised access to systems or data;

  • using automated tools (scrapers, crawlers, bots) in a way that overloads or disrupts the platform;

  • manipulating prices, reviews or availability in a deceptive way;

  • engaging in fraudulent bookings or payment activities;

  • uploading or transmitting content that is illegal, defamatory, infringing, discriminatory or otherwise harmful.

Bigmedia24 reserves the right to block, restrict or terminate access for users, Properties or Partners who engage in prohibited activities, and to take legal action where appropriate.

16. Liability

Nothing in these Terms excludes or limits liability:

  • for death or personal injury caused by negligence;

  • for fraud or fraudulent misrepresentation; or

  • to the extent such exclusion or limitation is not permitted by mandatory law.

Subject to the above:

  • Bigmedia24 is not responsible for the quality, safety, legality, suitability or actual performance of services provided by Properties or Partners (including accommodation, transportation or other travel services). Those services are delivered under the direct responsibility of the Property or Partner.

  • To the maximum extent permitted by law, Bigmedia24’s liability in connection with the use of its platforms is limited to foreseeable and direct damages caused by Bigmedia24’s material breach of contractual obligations or gross negligence.

  • Bigmedia24 is not liable for indirect, consequential or punitive damages, loss of profit, loss of goodwill, loss of data or business interruption, except where such limitations are not allowed by mandatory law.

For B2B relationships (Properties, Partners, OTAs, affiliates), more specific liability and limitation clauses may be agreed in separate contracts. In case of conflict, such specific provisions prevail.

17. Governing Law & Jurisdiction

These Terms and any contractual or non-contractual disputes arising out of or in connection with them are governed by the laws of Ireland, without regard to conflict of law principles.

For:

  • B2B disputes (for example with Properties, OTAs, Partners, Affiliates), the parties submit to the exclusive jurisdiction of the competent courts in Ireland, subject to any mandatory provisions of applicable law.

  • B2C disputes (with consumers), the following applies:

    • if you are a consumer resident in the European Union, the courts of your habitual residence may have jurisdiction and you may benefit from mandatory consumer protection provisions of your country of residence;

    • nothing in these Terms affects any mandatory rights you may have under the laws of your country of residence that cannot be contractually waived.

Where applicable, you may also use recognised alternative dispute resolution or online dispute resolution mechanisms, as provided by relevant laws.

18. Changes to These Terms

Bigmedia24 may amend these Terms from time to time to:

  • reflect changes in legal or regulatory requirements;

  • adapt to new products, features or business models;

  • improve clarity, security and usability.

The newest version will always be available under /terms/ and will show the “Last updated” date at the top.

  • For material changes, we will take reasonable steps to inform you (for example via notice on the website, email or in-account notification), especially where consumer rights may be affected.

  • If you continue to use our platforms after changes take effect, you are deemed to accept the updated Terms.

If you do not agree to the updated Terms, you must stop using our platforms and, where applicable, close your account.

19. Language & Interpretation

These Terms may be translated into different languages. In case of inconsistencies between language versions, the English version shall prevail, unless local law requires otherwise.

If any provision of these Terms is or becomes invalid or unenforceable, the remaining provisions remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the economic intent of the original provision.
