API Terms of Use

Read the API Terms of Use for Bigmedia24 Dynamics Ltd. These terms govern access to and use of Bigmedia24 APIs by hotels, OTAs, affiliates, technology partners and developers integrating with our booking and travel platforms.

These API Terms of Use (“API Terms”) govern access to and use of application programming interfaces, SDKs, technical documentation and related tools provided by Bigmedia24 Dynamics Ltd. (“Bigmedia24”, “we”, “us”, “our”).

The API is intended for use by hotels, property managers, OTAs, travel brands, affiliates, technology partners and developers acting on their behalf (together “API Clients” or “you”).

These API Terms form part of Bigmedia24’s overall legal framework and should be read together with:

Important note: These API Terms are a general framework and do not replace individual legal advice or specific API or data processing agreements. We recommend that you have these Terms reviewed by qualified legal counsel before publication or acceptance.

1. Scope & Parties

These API Terms apply to:

– any access to Bigmedia24 APIs, SDKs, web services, technical documentation or related developer tools provided by Bigmedia24
– any integration of Bigmedia24 functionality into your own systems, websites, apps or partner platforms

By requesting, receiving or using API credentials, or by sending requests to a Bigmedia24 API, you agree to be bound by these API Terms on behalf of yourself and, where applicable, the organisation you represent.

If you do not agree to these API Terms, you must not use the API.

2. Relationship to Other Terms

These API Terms:

– supplement our general Terms of Use & Booking Conditions (/terms/)
– are in addition to any specific contracts, partner agreements, white-label agreements or data processing agreements you may have with Bigmedia24
– operate alongside our Privacy Policy (/privacy-policy/) and Cookie Policy (/cookie-policy/)

In the event of conflict:

– specific written agreements (for example a partner contract or data processing agreement) prevail over these API Terms to the extent of the conflict
– these API Terms prevail over general website terms for matters specifically related to API access and use

3. Definitions

For the purposes of these API Terms:

“API” means any application programming interface, SDK, webhook, feed, technical endpoint or related documentation provided by Bigmedia24.

“API Client” means a hotel, property manager, OTA, travel brand, affiliate, technology company or developer authorised to access and use the API.

“API Data” means all data accessible via the API, including but not limited to availability, rates, booking details, property content, configuration data and usage metrics.

“Credentials” means access tokens, API keys, client IDs, secrets, certificates or other authentication or security details used to access the API.

“Personal Data” has the meaning given in the GDPR and similar data protection legislation and includes any information relating to an identified or identifiable natural person.

4. Access to the API

To access the API, you must:

– apply for access or be onboarded by Bigmedia24 as a recognised API Client
– receive Credentials from Bigmedia24 or via an authorised registration flow
– use the API only within the scope and technical limits communicated by Bigmedia24

Bigmedia24 may:

– grant or refuse API access at its sole discretion
– provide sandbox and/or production environments under different conditions
– suspend or revoke API access if you breach these API Terms, your contract with us, or applicable law

You are responsible for ensuring that only authorised persons within your organisation use the Credentials and access the API.

5. Licence & Permitted Use

Subject to these API Terms and any applicable commercial agreement, Bigmedia24 grants you a limited, non-exclusive, non-transferable, revocable licence to:

– access and use the API for the purpose of integrating Bigmedia24 services with your own systems, websites, apps or partner solutions
– use API Data only as necessary to provide or support travel-related services, internal operations, analytics and customer experiences that align with your agreement with Bigmedia24

This licence:

– does not grant you any ownership rights in the API or API Data
– is limited to the purpose and scope agreed between you and Bigmedia24
– may be revoked at any time in accordance with Section 14 (Term & Termination)

6. Restrictions

You must not:

– use the API in any way that violates law, these API Terms or any other agreement with Bigmedia24
– circumvent or attempt to circumvent any security, authentication or rate-limiting mechanisms
– copy, modify, reverse engineer, decompile or create derivative works based on the API, except to the extent permitted by mandatory law
– use the API to build a competing service or platform that is substantially similar to Bigmedia24’s core offerings
– sell, resell, sublicense, rent, lease or otherwise provide API access or API Data to third parties except as explicitly permitted in writing
– store or process API Data in a way that is inconsistent with applicable data protection laws or with any data processing agreement concluded with Bigmedia24
– misrepresent the source of data or present API Data as if it were collected directly by you when it originates from Bigmedia24 or its partners

You are responsible for ensuring that any third parties or subcontractors you use (for example developers or integrators) comply with these restrictions.

7. Data Protection & Personal Data via the API

When using the API, you may access or transfer Personal Data, such as:

– traveller booking details
– property contact information
– account and configuration data for users or properties

You agree to:

– process Personal Data obtained via the API only for legitimate, clearly defined purposes that are compatible with your agreement with Bigmedia24
– implement appropriate technical and organisational measures to protect Personal Data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access
– comply with all applicable data protection laws, including the GDPR and local regulations, where relevant
– promptly notify Bigmedia24 of any actual or suspected Personal Data breach relating to data obtained via the API

The precise controller–processor relationship (for example whether you act as an independent controller, joint controller or processor) depends on your specific integration and contractual arrangement with Bigmedia24. These roles and obligations should be set out in a separate data processing agreement or in your main contract.

8. Security & Credentials

You must:

– keep all Credentials strictly confidential and secure
– not share Credentials outside your organisation or with unauthorised individuals
– notify Bigmedia24 immediately if you suspect any loss, theft, misuse or unauthorised disclosure of Credentials or access to your systems
– implement reasonable technical measures (for example access controls, encryption, logging) to protect API integrations

You are responsible for all API requests made using your Credentials, regardless of whether those requests were authorised by you or not, unless you have promptly informed Bigmedia24 of a security incident in accordance with this section.

9. Rate Limits & Fair Use

Bigmedia24 may impose rate limits or quotas on API usage, including:

– maximum number of requests per minute, hour or day
– limits on concurrent connections or sessions
– restrictions on certain high-load endpoints

These limits:

– are designed to protect overall platform performance and stability
– may be communicated in documentation, dashboards or during onboarding
– may be adjusted by Bigmedia24 from time to time based on technical considerations

You must not intentionally exceed rate limits or attempt to circumvent them. If your legitimate use case requires higher limits, please discuss this with your Bigmedia24 contact.

10. Availability & Changes to the API

Bigmedia24 endeavours to provide stable and reliable API access, but:

– we do not guarantee uninterrupted or error-free availability of the API
– maintenance, updates, security work or technical issues may temporarily affect access
– we may modify, deprecate or discontinue parts of the API at any time

Where feasible and appropriate:

– we will provide reasonable notice before making backward-incompatible changes or deprecating endpoints
– we may provide migration paths, updated documentation or alternative endpoints

You are responsible for monitoring communications from Bigmedia24 (for example developer portals, email updates) and for updating your integrations accordingly.

11. Intellectual Property

All intellectual property rights in and to the API, documentation, SDKs and underlying technology are owned by or licensed to Bigmedia24.

These API Terms do not transfer ownership of any intellectual property rights to you.

You retain ownership of:

– your own software, systems and content
– your own trademarks and branding

By using the API, you grant Bigmedia24 a non-exclusive, worldwide, royalty-free licence to use your name, logo and limited descriptive information solely for the purpose of:

– identifying you as an API Client
– describing integrations in documentation, presentations or on our websites, unless you explicitly object in writing

12. Fees & Commercial Terms

Use of the API may be:

– included as part of a broader service or partnership agreement with Bigmedia24, or
– subject to specific fees, usage-based pricing or other commercial conditions

Any applicable fees and commercial terms:

– are defined in your individual contract, order form or partner agreement with Bigmedia24
– may refer to or interact with general information provided on the Sales & Commercial Information page (/sales/)

In case of conflict between these API Terms and a signed commercial agreement, the signed agreement will prevail with respect to pricing and commercial conditions.

13. Third-Party Services & Dependencies

The API may depend on or interact with third-party services, such as:

– payment processors
– channel managers and PMS providers
– analytics and logging services
– infrastructure and hosting providers

Bigmedia24 is not responsible for availability, performance or legal compliance of third-party services that are outside our control. Your use of such services may be subject to additional terms and privacy policies imposed by those third parties.

14. Term & Termination

These API Terms apply from the moment you first access the API and remain in effect until:

– your API access is revoked or terminated by Bigmedia24, or
– your contractual relationship with Bigmedia24 ends, where API access is linked to such a contract

Bigmedia24 may suspend or terminate API access, in whole or in part, if:

– you breach these API Terms or any other applicable agreement
– your use of the API creates risk for Bigmedia24, our partners or users
– we are required to do so by law or by a competent authority
– we discontinue the API or the underlying services

Upon termination:

– you must immediately stop using the API and delete any Credentials
– you must cease any automated data collection via the API
– continued storage and use of API Data must comply with applicable laws and with any surviving obligations under your agreements with Bigmedia24 (for example data deletion duties)

15. Warranties & Disclaimers

To the fullest extent permitted by law:

– the API is provided “as is” and “as available”
– Bigmedia24 makes no warranties, express or implied, regarding the API, including warranties of merchantability, fitness for a particular purpose, non-infringement or availability

You acknowledge that:

– the API may not be free from errors or interruptions
– integration with your own systems may require configuration and testing
– data obtained via the API may partly originate from third parties (for example properties, partners) and may change over time

Nothing in these API Terms is intended to exclude or limit any rights or remedies that cannot be excluded or limited under applicable law.

16. Liability

Nothing in these API Terms excludes or limits liability:

– for death or personal injury caused by negligence
– for fraud or fraudulent misrepresentation
– to the extent such exclusion or limitation is not permitted by mandatory law

Subject to the above and to any specific limits agreed in your contract with Bigmedia24:

– Bigmedia24’s liability in connection with the API is limited to foreseeable and direct damages caused by Bigmedia24’s material breach of these API Terms or by gross negligence
– Bigmedia24 is not liable for indirect, incidental, consequential or punitive damages, loss of profit, loss of business, loss of data or loss of goodwill arising from or in connection with your use of the API

For B2B relationships, more detailed limitations and caps may be set out in your individual agreement with Bigmedia24. In case of conflict, those provisions prevail.

17. Indemnity

You agree to indemnify, defend and hold harmless Bigmedia24, its directors, employees and affiliates from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or in connection with:

– your misuse of the API or API Data
– your breach of these API Terms or any other applicable agreement with Bigmedia24
– your violation of applicable laws or third-party rights in connection with your use of the API

This indemnity applies to B2B API Clients and does not affect any rights you may have as a consumer under mandatory law, where applicable.

18. Governing Law & Jurisdiction

These API Terms and any disputes arising out of or in connection with them are governed by the laws of Ireland, without regard to conflict of law principles.

For B2B API Clients:

– the parties submit to the exclusive jurisdiction of the competent courts in Ireland, subject to any mandatory provisions of applicable law.

If you access the API in a consumer context (which is generally not the intended use of the API), statutory consumer protection rules and jurisdiction provisions of your country of residence may apply.

19. Changes to These API Terms

We may update these API Terms from time to time to reflect:

– changes in our APIs, services or business model
– developments in legal or regulatory requirements
– feedback from partners, clients or authorities

The current version of the API Terms is always available at:

If changes are material, we will take reasonable steps to inform affected API Clients, for example via email, developer portals or in-dashboard notifications.

If you continue to use the API after updated API Terms take effect, you are deemed to accept the changes. If you do not agree, you must stop using the API and disable your integrations.
